Grounds for an Annulment in Texas
In a divorce, it is assumed that a couple’s legitimate marriage has crumbled beyond repair and they want to dissolve all legal ties with one another. In an annulment, however, it is recognized that the marriage has suffered by some form of fraud and was never legitimate to begin with.
Annulments can be granted in Texas if, at the time of the marriage:
- One spouse suffered from permanent impotency
- One spouse was already married
- One spouse was mentally incapacitated
- One spouse was under the influence of drugs or alcohol
- One spouse had been divorced within 30 days
- One spouse was forced to marry or under duress
- One spouse was too closely related to the other
